Article n°5 of the EPR series: Waste from Electrical and Electronic Equipment (WEEE) regarding the Extended Producer Responsibility (EPR) regulations

What are WEEE?

Electronical and Electrical Equipment (EEE) are defined as “equipment which is dependent on electric currents or electromagnetic fields in order to work properly and equipment for the generation, transfer and measurement of such currents and fields”. Waste from Electrical and Electronic Equipment (WEEE) is a designation for “certain kinds of hardware and other electrical appliances”.

Companies must join a Producer Responsibility Organization (PRO) if they sell those products

  • Climatic engineering equipment
  • Screens, monitors and IT equipment with screens larger than 100 cm2
  • Large device (one of the outer dimensions being 50 cm or more)
  • Small device (all of the outer dimensions are equal to or less than 50 cm)
  • Telecommunication and IT equipment (all of the outer dimensions are equal to or less than 50 cm)

Producer’s obligations

Producers must take responsibility for the EEE products they put on the market when it is time for them to be dismantled. They must join a Producer Responsibility Organization (PRO). Producers must:

  • Register on the SYDEREP website, the national register for producers of the French Environment and Energy Control Agency (ADEME)
  • Declare each year the number of EEE products and their total weight introduced on the French market, as well as the percentage of recyclable materials per equipment
  • Inform customers about more sustainable purchases
  • Pay for the gathering and processing of the equipment in addition to support the repair and reuse of such equipment
  • Hand over annual reports presenting said gathering and processing to the public authorities

Documents required to join a Producer Responsibility Organization (PRO)

  • The WEEE adhesion contract
  • The declaration of the number of EEE products sold and their total weight that were sold on the French market
  • The invoice based on the EPR product declaration or on the scale contribution minimum
